Section 144 Imposed In Assam's Darrang District – Here's Why?

Guwahati: In a bid to prevent a breach of peace and tranquility, the Darrang district magistrate on Wednesday imposed Section 144 CRPC with immediate effect.

The order will remain in force until further orders.

''Whereas, it appears to me that there is every likelihood of breach of peace and tranquility in the district of Darrang as per the prevailing situation;

Whereas, for smooth functioning of normal life and to ensure a healthy and pollution-free environment in the district, certain measures need to be taken urgently:

And whereas I am satisfied that there is a need in the district of Darrang which warrants the imposition of prohibitory order under Section 144 Cr.P.C; Now, therefore 1, Pranab Kr. Sarmah, District Magistrate, Darrang, Mangaldai do hereby prohibit the followings to prevent any probable breach of peace and tranquility,'' the order from Darrang District Magistrate read.

As per the order, there is a ban on any procession / demonstration / blockade on National Highway - 15 and roaming in public places / travelling in buses without wearing a face mask.

''Entry of unauthorized person or unnecessary crowding, Dharna within 100 (one hundred) meters radius of the Deputy Commissioner's office. Assembly of five or more persons in public places including National Highway without permission from the authority concerned is banned,'' the order read further.

The district magistrate has also banned procession, meetings, protest meetings, Dharna, or Rallies which may create communal tension.

The order further said that the holding of the public meeting, rallies, and demonstrations in public places without permission from the competent authority.

''Carrying bags, plastic sheets, multi-layered packaging less than 50 microns; plastic cups with diameter less than 60 mm and thickness less than 50 microns: short life PVC and chlorinated plastic bags, sheets, banners, flex, bunting, flags, irrespective of thickness are banned'' it added.

It has put a curb on financial collection (Chanda), forceful subscriptions, donations, roadside collection, and extortion in any manner or form of any person, business establishments are also banned.

Furthermore, manufacture, storage, transportation, display, distribution, or sale of Giutkha, Pan Masala, or any chewing materials, etc. (by whatsoever name) containing tobacco and/or nicotine as ingredients available in the market are also restricted.

''Carrying and display of arms, Lathies, Lethal weapons, Sharp instruments, Bows and arrows, Daggers, Daos, Swords, Trishuls, etc. by any person or group of persons in public places are also banned.

The District Magistrate in the order has mentioned that any persons in the case this prohibitory order is violated, the offenders will be prosecuted under his hand and seal on the second day of May.
